Florida FMLA Guidance for Employees
Florida employees generally rely on federal FMLA, employer policies, PTO and disability benefits if available. Florida does not currently have a broad mandatory paid family and medical leave program for most private-sector employees.
Leave Programs That May Matter in Florida
May provide up to 12 weeks of unpaid, job-protected leave for eligible employees of covered employers.
Florida does not currently require most private-sector employers to provide a broad paid family and medical leave program.
Florida law allows voluntary paid family leave insurance products, but that does not mean every employee has coverage.
STD may help replace income if available through your employer or a private policy. STD does not automatically protect your job.
Common Employee Confusion
- Employees may assume Florida has paid leave like California or New York. Most private employees do not have a broad state program.
- Employer policy matters heavily in Florida.
- Being approved for disability benefits does not automatically mean your job is protected.
- FMLA eligibility and disability benefit eligibility are separate questions.
What to Check Before You Act
- Whether your employer is covered by FMLA.
- Whether you meet the 12-month and 1,250-hour FMLA eligibility rules.
- Whether your employer offers STD, PTO, unpaid medical leave or accommodation options.
- Whether your communication with HR is documented in writing.
Important Reminder
FMLA, state leave, disability benefits, PTO and employer policies are separate systems. A benefit may pay wages without protecting the job, and a job-protected leave may be unpaid.
The safest move is to document your request in writing, keep copies of employer responses, and confirm which leave or benefit program is being used.
