Georgia FMLA Guidance for Employees

Georgia private-sector employees generally rely on federal FMLA, employer policies, PTO and disability benefits if available. Georgia does not have a state FMLA-style law for most private-sector employees, so the federal rules are usually the starting point.

Leave Programs That May Matter in Georgia

Federal FMLA

May provide up to 12 weeks of unpaid, job-protected leave for eligible employees of covered employers.

Georgia State Leave

Georgia does not have a separate FMLA-style state family and medical leave law for most private-sector employees.

Georgia Kin Care Sick Leave

If an employer provides paid sick leave, some Georgia employees may be able to use up to five days of earned sick leave per calendar year to care for an immediate family member.

Employer Policies

Employer attendance policies, PTO policies, unpaid leave policies and disability benefits may still matter even when Texas does not add a separate state leave program.

Short-Term Disability

STD may provide income replacement if your employer offers it or you enrolled in coverage. STD is not the same thing as FMLA job protection.
