Illinois FMLA and Paid Leave Guidance

Illinois employees may deal with federal FMLA, the Illinois Paid Leave for All Workers Act, employer leave policies, PTO, and disability benefits if available. Illinois has a statewide paid leave law, but that paid leave is separate from FMLA job protection.

Leave Programs That May Matter in Illinois

Federal FMLA

May provide up to 12 weeks of unpaid, job-protected leave for eligible employees of covered employers.

Illinois Paid Leave for All Workers Act

Allows many Illinois employees to earn up to 40 hours of paid leave per year. Workers earn one hour of paid leave for every 40 hours worked, and the leave may be used for any reason.

Chicago and Cook County Leave Rules

Some employees in Chicago or Cook County may be covered by local leave ordinances or local paid sick leave rules instead of, or in addition to, statewide rules.

Short-Term Disability

STD may provide income replacement if your employer offers it or you enrolled in coverage. STD does not automatically protect your job.

Employer Policies

Employer PTO, attendance, unpaid leave, and disability benefit policies may still matter even when federal or state leave applies.

FMLA, state leave, disability benefits, PTO and employer policies are separate systems. A benefit may pay wages without protecting the job, and a job-protected leave may be unpaid.

The safest move is to document your request in writing, keep copies of employer responses, and confirm which leave or benefit program is being used.
