New Jersey Employee Leave Guide

New Jersey FMLA, NJFLA, TDI and FLI Guidance

New Jersey employees may deal with federal FMLA, the New Jersey Family Leave Act, Temporary Disability Insurance and Family Leave Insurance. New Jersey is important because pay benefits and job-protected leave may come from different systems.

Leave Programs That May Matter in New Jersey

Federal FMLA

May provide up to 12 weeks of unpaid, job-protected leave for eligible employees, including leave for the employee’s own serious health condition.

NJFLA

The New Jersey Family Leave Act may provide job-protected leave for certain family-care and bonding situations. It generally does not cover the employee’s own medical condition in the same way FMLA does.

New Jersey TDI

Temporary Disability Insurance may provide wage replacement for an employee’s own non-work-related illness, injury, pregnancy or childbirth recovery.

New Jersey FLI

Family Leave Insurance may provide wage replacement for bonding with a new child or caring for a family member.

2026 Expansion Note

New Jersey family leave rules are changing in 2026. Employees should verify current coverage thresholds and job-protection rules before relying on older information.

Common Employee Confusion

What to Check Before You Act

Important Reminder

FMLA, state leave, disability benefits, PTO and employer policies are separate systems. A benefit may pay wages without protecting the job, and a job-protected leave may be unpaid.

The safest move is to document your request in writing, keep copies of employer responses, and confirm which leave or benefit program is being used.
