New York FMLA, Paid Family Leave and Disability Guidance
New York employees may deal with federal FMLA, New York Paid Family Leave and New York Disability Benefits Law. The major issue is that bonding and family leave benefits are much stronger than the state disability benefit for an employee’s own medical condition.
Leave Programs That May Matter in New York
May provide up to 12 weeks of unpaid, job-protected leave for eligible employees. FMLA does not pay wages.
May provide up to 12 weeks of paid, job-protected leave for bonding, family care or certain military-related needs. For 2026, the maximum weekly PFL benefit is $1,228.53.
Disability Benefits Law may provide benefits for an employee’s own off-the-job illness or injury. The state benefit is limited to 50% of wages, capped at $170 per week.
New York states that combined disability leave and Paid Family Leave may not exceed 26 weeks in any 52-week period.
Common Employee Confusion
- New York PFL is not the same thing as disability leave.
- DBL is for your own medical condition. PFL is generally for bonding, family care or military-related qualifying events.
- DBL pay is very low compared with PFL.
- Employees may need to ask whether the employer offers private short-term disability beyond the state minimum.
What to Check Before You Act
- Whether the leave is for your own condition or someone else’s care/bonding.
- Whether FMLA is also being designated by your employer.
- Whether you are applying through the employer’s insurance carrier.
- Whether your employer offers enhanced STD beyond New York DBL.
Important Reminder
FMLA, state leave, disability benefits, PTO and employer policies are separate systems. A benefit may pay wages without protecting the job, and a job-protected leave may be unpaid.
The safest move is to document your request in writing, keep copies of employer responses, and confirm which leave or benefit program is being used.
