Virginia FMLA and Paid Family Medical Leave Guidance

Virginia employees may deal with federal FMLA, employer policies, PTO, disability benefits, and Virginia's new Paid Family and Medical Leave program as it rolls out. The Virginia PFML program was enacted in 2026, with benefits scheduled to begin in 2028.

Leave Programs That May Matter in Virginia

Federal FMLA

May provide up to 12 weeks of unpaid, job-protected leave for eligible employees of covered employers.

Virginia Paid Family and Medical Leave

Virginia has enacted a PFML program. The state announced that working Virginians will have access to up to 12 weeks of paid time off beginning in 2028 for qualifying reasons.

Program Timing

Virginia PFML is not an immediate benefit for current 2026 leave situations. Employees should verify current rollout dates before relying on the program.

Employer Policies

Until Virginia PFML benefits are available, many employees still rely on employer PTO, unpaid leave, STD, and other benefit policies.

Short-Term Disability

STD may provide income replacement if available. STD is separate from FMLA job protection.
