Virginia Employee Leave Guide
Virginia FMLA and Paid Family Medical Leave Guidance
Virginia employees may deal with federal FMLA, employer policies, PTO, disability benefits, and Virginia's new Paid Family and Medical Leave program as it rolls out. The Virginia PFML program was enacted in 2026, with benefits scheduled to begin in 2028.
Leave Programs That May Matter in Virginia
May provide up to 12 weeks of unpaid, job-protected leave for eligible employees of covered employers.
Virginia has enacted a PFML program. The state announced that working Virginians will have access to up to 12 weeks of paid time off beginning in 2028 for qualifying reasons.
Virginia PFML is not an immediate benefit for current 2026 leave situations. Employees should verify current rollout dates before relying on the program.
Until Virginia PFML benefits are available, many employees still rely on employer PTO, unpaid leave, STD, and other benefit policies.
STD may provide income replacement if available. STD is separate from FMLA job protection.
Common Employee Confusion
- Virginia's PFML program has been enacted, but benefits are not available immediately.
- Federal FMLA may apply now even before Virginia PFML benefits begin.
- STD, PTO, FMLA, and future PFML benefits are separate systems.
- Employees should confirm whether their current leave is covered by FMLA, employer policy, or a disability benefit.
What to Check Before You Act
- Whether federal FMLA applies to your current leave.
- Whether your employer offers STD, PTO, paid leave, or unpaid medical leave now.
- Whether your situation will occur before or after Virginia PFML benefits become available.
- Whether HR has confirmed your leave designation and benefit options in writing.
Important Reminder
FMLA, state leave, disability benefits, PTO and employer policies are separate systems. A benefit may pay wages without protecting the job, and a job-protected leave may be unpaid.
The safest move is to document your request in writing, keep copies of employer responses, and confirm which leave or benefit program is being used.
